General Provisions

1. These Staking Terms of Use (the “Staking Terms”) incorporate by reference and supplement the Terms of Use (the “Terms of Use”) and other documents, information, and policies available on the Website (including the Legal Considerations, Risks, And Disclaimers). Capitalized terms used but not defined herein shall have the meanings given to them in the Terms of Use. In the event of a conflict between the Terms of Use and this Staking Terms with respect to staking, the terms of this Staking Terms will control.
2. We in Monkey League provide the option to contribute and earn rewards by participating in on-chain staking program, subject to the terms and conditions of this Staking Terms (the “Staking”). These on-chain Staking services, as made available by MBS SP Limited, a British Virgin Islands company (“MBS SP” or “We”), may be offered (permanently or from time to time) to the Our community who hold MBS tokens, that fulfill the eligibility criteria in the Staking Terms and Terms of Use.
3. Staking is a way for Monkey League to reward its community for having a long-term mindset and locking up their MBS tokens. By staking your MBS tokens, you will have the opportunity to be entitled to rewards. The Staking program’s rewards will be distributed by MBG LLC, a Saint Vincent and the Grenadines company (“MBG”).
4. Staking Your MBS tokens means that Your MBS tokens are held in a cryptocurrency wallet on the blockchain network.
5. When You stake your MBS tokens, You retain ownership of your MBS tokens and they shall remain property of you when staked under the terms of this Staking Terms.
6. MBS SP reserve the right to adapt and amend these Staking Terms at any time without any prior notice.

End of Term

1. At the end of the Staking term and upon claiming in the dedicated place on the Website, Your MBS tokens and the rewarded MBS tokens will be sent back to the wallet You used in order to participate in the Staking. You will not be able to claim for MBS tokens before the end of the Term.

Disclaimer

1. We do not make any representations or warranties with regards to the accuracy, the correctness, results, or reliability of the use of the materials and information on our Staking program on the Website or specific returns to be generated through Your use of the program on this Website.
2. The Staking program is provided on an ‘as is’ basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
3. By using and continuing to use the Staking program, You agree that you understand the Staking Terms and the Terms of Use.
4. You agree that nor We or MBG guarantee that We or MBG will distribute Staking rewards to You, and that where MBG do so, the applicable percentage of Staking rewards set out on the Website: (a) are estimates only; (b) are not guaranteed; and (c) may change at any time in Our sole discretion.

Liability

1. IN NO EVENT AND UNDER NO LAW-THEORY OF LIABILITY, INCLUDING CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, WARRANTY, OR OTHERWISE, WE WILL BE LIABLE TO YOU FOR ANY DIRECT OR INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES, INCLUDING THOSE ARISING FROM OR RELATING TO CONTENT AND MATERIAL MADE AVAILABLE ON THE SERVICES THAT IS ALLEGED TO BE DEFAMATORY, OFFENSIVE, OR ILLEGAL. ACCESS TO, AND USE OF, THE STAKING PROGRAMS IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR COMPUTER SYSTEM, OR LOSS OF DATA RESULTING THEREFROM. THE LIMITATIONS OF THIS SECTION WILL APPLY TO ANY LAW-THEORY OF LIABILITY, INCLUDING THOSE BASED ON WARRANTY, CONTRACT, STATUTE, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGE, AND EVEN IF ANY REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED ITS ESSENTIAL PURPOSE. FURTHERMORE, ANY LIABILITY IS LIMITED TO THE EXTENT PERMITTED BY LAW. TO THE EXTENT THE FOREGOING EXCLUSION OF LIABILITY IS NOT PERMITTED UNDER APPLICABLE LAW, OUR LIABILITY IN SUCH A CASE WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Changes or End of Service

1. We reserve the right to modify, suspend, or discontinue the Staking programs (in whole or in part) at any time, with or without notice to you. Any future release, update, or other addition to the functionality of the Staking programs will be subject to these Staking Terms, which may be updated from time to time. We reserve the right to adjust the characteristics, payout, transfers, timeframes, and any other related matter of the Staking program at any time without any prior notice.
2. You agree that We will not be liable to You for any modification, suspension, outage, or discontinuation of the Staking programs or any part thereof.
3. All provisions of the terms and conditions which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

No Guarantee

1. While We take measures to ensure that the Staking is accessible, We cannot guarantee the uninterrupted or error-free operation of the Staking or that We will correct all defects or prevent third-party disruptions or unauthorized third-party access. In the event of such disruptions, any staked MBS tokes may not be generating the rewards.

Tax

1. The tax treatment of certain digital currency transactions is uncertain, including Your voluntary election to stake Your MBS tokens, and it is Your responsibility to determine what taxes, if any, arising from these transactions. You are solely responsible for reporting and paying any applicable taxes arising from Staking through the Website and all related transactions and acknowledge that MBS SP does not provide investment, legal, or tax advice to You in connection with such election to participate. You should conduct Your own due diligence and consult your advisors before making any decision including whether to participate in Staking and related transactions.

No Advice

1. Information provided on the Website is not intended to constitute investment or other advice on financial products. Such information is not, and should not be read as, an offer or recommendation to hold, stack, claim, buy or sell or a solicitation of an offer or recommendation to hold, stack, claim, buy or sell any digital asset or to use any particular decision. We make no representations as to the accuracy, completeness, timeliness, suitability, or validity of any information on this Website and will not be liable for any errors, omissions, or delays in this information or any losses, injuries, or damages arising from its display or use.

Regional Restrictions

1. Citizens, nationals, residents (tax or otherwise), green card holders, entities organized and/or Restricted Persons of any Restricted Jurisdiction (as defined below) are not permitted to participate and are expressly prohibited from participating in the Staking program according to this Staking Terms. “Restricted Jurisdiction” means (a) United States of America (and its territories, including Puerto Rico), British Virgin Islands, Israel, Cuba, Iran, North Korea, Sudan, Syria, Lebanon, Russia and the Crimea, Donetsk or Luhansk regions of Ukraine; (b) any jurisdiction listed in any sanction list issued by (i) the United States of America, (ii) the United Nations Security Council, (iii) the European Union, (iv) the United Kingdom, (v) Israel or (vi) the respective governmental institutions of any of the foregoing including, without limitation, the Financial Action Task Force (FATF), Her Majesty’s Treasury, the Office of Foreign Assets Control of the US Department of the Treasury, the US Department of Commerce, the US Department of State or any other agency of the US government, the Israeli Ministry of Finance and the Israeli Ministry of Defense, each as amended, supplemented or substituted from time to time; or (c) any other jurisdiction which prohibits or requires any supervision oversight licensing regulatory compliance legal compliance and/or prior approval from any regulatory (or similar) authority or body or form any monetary or securities body or authority for the participation in a Staking program and/or the purchase of digital curries or any similar activity or product. “Restricted Persons” refers to any individual, firm, company, partnership, trust, corporation, entity, government, state or agency of a state or any other incorporated or unincorporated body or association, association or partnership (whether or not having separate legal personality) that is established and/or lawfully existing under the laws of a Restricted Jurisdiction or is listed under any sanction list administered a country stated in section 9(b) above.
